Release of Liability and Assumption of Risk Policies
1. Assumption of Risk By enrolling in classes or participating in any activities at Limelight 8 LLC, you acknowledge and understand that dance, cinematography, and related activities involve inherent risks, including but not limited to physical injury, emotional distress, and property damage. You voluntarily assume all risks associated with these activities, whether known or unknown, and accept full responsibility for your participation.
2. Release and Waiver In consideration of being allowed to participate in any activities at Limelight 8 LLC, you hereby release, waive, and discharge Limelight 8 LLC, its owners, instructors, employees, agents, representatives, and affiliates from any and all claims, demands, causes of action, and liabilities arising out of or related to any injury, loss, or damage sustained during or in connection with your participation in any activity at Limelight 8 LLC.
3. Indemnification You agree to indemnify and hold harmless Limelight 8 LLC, its owners, instructors, employees, agents, representatives, and affiliates from any and all claims, demands, damages, or losses, including legal fees and costs, arising out of or related to your participation in any activities at Limelight 8 LLC or any breach of this agreement.
4. Medical Treatment You acknowledge and agree that Limelight 8 LLC and its staff are not responsible for providing medical care or treatment in the event of an injury. You consent to receiving emergency medical treatment deemed necessary by Limelight 8 LLC staff, and you agree to be responsible for any costs associated with such treatment.
5. Media and Intellectual Property You understand and agree that Limelight 8 LLC may capture images, audio, and video recordings of participants during classes, performances, and other activities. These materials may be used by Limelight 8 LLC for promotional purposes. You release Limelight 8 LLC from any claims related to the use of such materials, including any claims for compensation.
6. Binding Agreement This release of liability shall be binding upon you, your heirs, legal representatives, and assigns. By enrolling in classes or participating in any activities at Limelight 8 LLC, you agree to abide by this release of liability and acknowledge that you have read and understood its terms.
7. Severability If any provision of this release of liability is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. By electronically agreeing, you confirm that you have read, understood, and agreed to the terms of this Release of Liability. Assumption of Risk As a participant, and/or the guardian of a participant, in the programs, activities, and events at Limelight 8 LLC, whether held at the Limelight 8 studio or elsewhere, I acknowledge and accept full responsibility for my own behavior and well-being and/or that of the minor participant. I understand the general nature of the risks involved in these activities, which may include but are not limited to exposure to or infection with COVID-19 or other infectious diseases, which may lead to minor to severe illness, injury, disability, and/or death, as well as the potential development of serious complications such as Multisystem Inflammatory Syndrome in Children (“MIS-C”); minor to severe physical, emotional, or psychological harm, injury, disability, and/or death; damage to or loss of personal property; and risks such as trips, falls, sprains, bruises, and broken bones. Parents expressly assume responsibility for all risks and dangers associated with their child's participation.
In the event of an accident or injury, I recognize that Limelight 8 LLC may need to make personal judgments regarding the actions to be taken on my behalf or on behalf of the minor participant. I understand that Limelight 8 LLC and its personnel may not have a legal obligation to act on my behalf or on behalf of the participant.
I also acknowledge that it is my responsibility to secure personal health insurance if desired and to consider my physical condition and that of the minor participant. I agree to comply with all specific requests made by Limelight 8 LLC for my safety and the safety of others, as well as all rules and policies set forth by Limelight 8 LLC that apply to activities related to this program.
I understand that Limelight 8 LLC reserves the right to exclude me or the minor participant from the program if our participation or behavior is deemed detrimental to our safety or the safety and welfare of others. In consideration for being allowed to participate in this program, and because I, as the participant or guardian of the participant, have agreed to assume the risks involved, I hereby acknowledge that I am responsible for any personal injury, damage to, or loss of my property. I understand that this Assumption of Risk Form will remain in effect during any subsequent visits and program-related activities unless I provide a written revocation of this document to the owner of Limelight 8 LLC, Boss Lady Virid, at which time my participation in the program will cease. Indemnification & Hold Harmless. To the fullest extent permitted by law, Parents on their own behalf, on behalf of Child, and on behalf of their successors, heirs, and assigns, agree to defend, indemnify, and hold the Released Parties, and each of them, harmless from and against any and all Claims to the extent such Claims are caused by or arise out of Child’s participation in in-Person classes, virtual classes, events and other activities associated with Limelight 8, LLC. I acknowledge that I have read and fully understand this document.
Media Wavier and Rights Policy
By enrolling in Limelight 8 LLC and entering our facility, you acknowledge and agree that you, your child, or any individuals accompanying you may be photographed, audiotaped, and video recorded during classes, events, and other activities. These images, audio recordings, videos, and any associated choreography are the exclusive property of Limelight 8 LLC. Authorization: You hereby authorize Limelight 8 LLC, its partners, agents, representatives, assigns, successors in interest, and licensees to photograph, audiotape, and/or videotape you. You grant Limelight 8 LLC and its partners the irrevocable right to use your photograph, audio recording, video recording, or any reproduction or modification thereof (the “Photograph,” “Audio,” and/or “Video”) in any manner or medium throughout the world an unlimited number of times in perpetuity. These uses may include advertising, trade, promotion, exhibition, or any other lawful purpose. No Compensation: You understand and agree that you will not receive any monetary compensation for the permissions granted herein. Waiver of Rights: You hereby waive any right to inspect or approve the uses to which Limelight 8 LLC may put the Photograph, Audio, and/or Video. You acknowledge that Limelight 8 LLC will rely on this permission and release and discharge Limelight 8 LLC from any and all claims and demands arising out of or in connection with the Photograph, Audio, or Video, or the exercise of the permissions granted here, including any claims for libel, invasion of privacy, or emotional distress. Irrevocable Consent: You understand that you cannot withdraw your consent after signing this form, and that this consent and release is binding on you and your heirs, legal representatives, and assigns. Enrollment Condition: Please note that if you do not agree to these terms, enrollment at Limelight 8 LLC will be denied. All participants must agree to this policy as a condition of enrollment. By continuing with enrollment, you are agreeing to this waiver and releasing Limelight 8 LLC from any claims related to the use and ownership of these images, audio, videos, and choreography.
